Terms of Service

1. Acceptance

By creating an account or using Wayfare, you agree to these Terms. If you don't agree, don't use the service.

2. Eligibility

You must be at least 18 years old to use Wayfare. By signing up, you confirm you meet this requirement.

3. Your account

You're responsible for keeping your password secure and for all activity under your account. You must provide accurate information and verify your identity when requested.

4. Acceptable use

You agree not to: harass, threaten, or impersonate others; post illegal, hateful, or sexually explicit content; spam, scrape, or abuse the service; share contact details of others without consent; use the platform for commercial solicitation without permission.

5. Your content

You keep ownership of everything you post (photos, messages, itineraries, reviews). You grant Wayfare a non-exclusive license to display, store, and process it as needed to operate the service.

6. Limitation of liability

WAYFARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY. Wayfare is a connection platform: we do not vet, employ, endorse, or absolutely verify other users. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Wayfare and its operators shall not be liable for: (a) any direct, indirect, incidental, consequential, special, or exemplary damages; (b) physical injury, death, economic, reputational, or emotional harm arising from user meetings; (c) the conduct, statements, identity, or intentions of any user; (d) loss of profits, opportunities, data, or goodwill. Wayfare's maximum aggregate liability for any claim is capped at the amount you actually paid Wayfare in the 12 months preceding the event, and in no event shall exceed €100.

7. Data security & breaches

We apply reasonable technical and organisational measures to protect your data (encryption in transit, password hashing, access controls, EU infrastructure). HOWEVER, NO COMPUTER SYSTEM IS UNBREACHABLE. You expressly acknowledge and accept that: (a) cyberattacks, unauthorised access, or data exfiltration may occur despite our precautions; (b) by sharing personal data, photos, and documents on the platform you accept this residual risk; (c) Wayfare does not guarantee absolute security and is not liable for losses or damages caused by third-party cyberattacks, zero-day vulnerabilities, service-provider errors (Supabase, Vercel, Stripe, Resend), or force-majeure events. In case of a breach affecting your data, we will notify you within 72 hours as required by GDPR and cooperate with the competent authorities.

8. Indemnity

You agree to indemnify, defend, and hold harmless Wayfare, its operators, employees, and providers from any claim, demand, damage, loss, or expense (including reasonable legal fees) arising from: (a) your content, conduct, or use of the service; (b) your meetings with other users, wherever they occur; (c) your breach of these Terms or any law; (d) your infringement of third-party rights (privacy, intellectual property, etc.).

9. Travel & meeting risks

Meeting strangers known online carries substantial and unpredictable risks. Wayfare provides safety tools (ID verification, trust score, reports, blocks, emergency contact) but DOES NOT GUARANTEE any user's identity, real age, intentions, personal safety, health status, or reliability. You are SOLELY RESPONSIBLE for your decisions to meet, travel, or share accommodation with other users. We recommend: meet first in public places, share your itinerary with a trusted person, keep financial and logistical autonomy, trust your instincts.

10. Expenses, money, transactions

Wayfare does not handle, custody, guarantee, or insure payments, loans, or transfers between users. The expense tracker is purely informational. Monetary disputes between users are EXCLUSIVELY between the parties involved; Wayfare does not arbitrate, refund, guarantee, or act as escrow. Paid subscriptions (Compass/Atlas/Horizon) are provided via Stripe under its terms; refunds follow applicable law.

11. Disputes & moderation

For user disputes, attempt direct resolution first. You can file formal reports through the platform; the team reviews and may apply sanctions (warning, suspension, ban) to violating accounts at its sole discretion, without obligation of detailed justification. Wayfare does not offer financial arbitration.

12. Force majeure

Wayfare shall not be liable for delays, interruptions, or non-delivery of the service due to causes outside our reasonable control, including: cyberattacks (DDoS, ransomware, zero-day), cloud-provider outages, blackouts, natural disasters, pandemics, government actions, wars, strikes, censorship, state-level internet blocks.

13. Termination

We may suspend or terminate your account at our discretion, with or without notice, in case of Terms violation, suspected fraud, or if continuing the service would expose us to legal risk. You may delete your account at any time; this removes personal data as described in the Privacy Policy, except data we must retain for legal obligations or legitimate interests (e.g. security logs, anti-fraud).

14. Changes to the Terms

We may update these Terms at any time. Significant changes will be notified via email or an in-app banner; you may be required to re-accept them to continue using the service. Continued use after changes means acceptance.

15. Governing law & jurisdiction

These Terms are governed by Italian law, except for mandatory consumer-protection rules of the user's country of residence. Exclusive jurisdiction: Court of Milan for disputes between Wayfare and non-consumer users; for consumers, the courts of the place of residence or domicile. The invalidity of any clause does not affect the validity of the remaining ones.

16. Contact

For any request (legal, privacy, security, account, billing, reports) use the built-in ticket system: go to Profile → Support and open a ticket. You will first get an answer from the automated assistant and, if needed, escalation to a real operator within 24-48 hours. We do not use public contact emails — the ticket channel guarantees traceability and predictable response times.
